Believing in the existence of the Creator God of the heavens and the earth makes us accept the fact that the origin of law is related to the creation of man, the natural law. Although many defend the thesis of the unique existence of the current of thought of positive law, the law dictated and imposed by the competent authority, there is no way to deny the existence of natural law, the immutable right of the human being. The constitutions of modern countries, incorporating the chapter on fundamental rights and guarantees, are indisputable proof of the existence of natural law. This chapter encompasses formulations of natural law, under the guise of positive law. Example of the Constitution of Brazil: Art. 5.º CF/88, of fundamental rights and guarantees:
"All are equal before the law, without distinction of any kind, guaranteeing Brazilians and foreigners residing in the country the inviolability of the right to life, liberty, equality,to safety and property..."(Art. 5 CF/88)
First is the right to life, the eternal right of the human being. The first man, Adam, created by God from the dust of the earth, sinned by his disobedience. So man lost the right to eternal life, and death overtook everyone. Consequences of sin, from the loss of freedom to the other ills of society. According to this broader thought of the right to life, the defense of natural law is made, opposed by defenders of the unique existence of positive law. The legal current of “just positivist” thinking is not discussed, as its importance for the regulation of society is indisputable. The various branches of law (Constitutional, criminal, commercial, labor, administrative, international, etc...). The constitutional right in the broader treatment of the organization of the people over the territory; criminal law in the fight against illicit; commercial law in the regulation of relations in the business area, etc... In each branch of law, its object and regulation by the competent authority, in the field of social relations is the most correct.
However, on the spiritual plane, the thought prevails that natural law overcomes positive law. To explain this statement, the theocratic State is mentioned, introducing the concept of justice. The system of law of the theocratic State, a system of law that in the Old Testament served to regulate the social relations of the people of God, after the exit from slavery in Egypt, is contemplated to this day in the legal order of nations. In summary, the system of law of the theocratic State is the 10 (ten) commandments, which in the form of moral imperatives, are compared to a constitution.
Every law is related to the existence of law and justice, thus, in a broader sense, justice is defined by respect for law. As in the human court there is a relationship between the authority of the law, law and justice, in the divine plan law is related to justice: Example, the right to life, natural and eternal right of human beings, lost because of sin.
Whether in the field of natural law or in the field of positive law, the exercise of our right is directly related to God's justice. An analogy between God's justice and the plan of the human court follows, signaling the way of life.
“The line of sin, making everyone guilty before God (Rom. 3:23), is compared to the plan of the human court (guilt, separation and condemnation). However, justification by faith in Jesus Christ removes condemnation through forgiveness of sins, removes guilt through the righteousness of God,
and restore fellowship through Jesus. "
